Dubuque To Require Criminal Background Checks

Dubuque is making some drastic changes to the city’s policy for rental properties.

Starting July 1st, the city will require all landlords to do a criminal background check on every person who wants to rent an apartment.

No exceptions.

If a landlord doesn’t do the background check, it could mean fines up to one thousand dollars.

Landlord Jerry Maro rents out a dozen or so apartments.

He has for almost four decades.

But in the past ten years, he says, things have really changed.

Maro said, “we seem to have a lot of good tenants but we also have tenants who seem to want to create problems for landlords.”

Maro says he doesn’t want to rent to people who have have drug problems, who deal drugs, and people who don’t pay rent. That’s why he screens everyone before they move in.

Now the city is making those free background checks mandatory.

David Harris, Director of Housing said, “The point is to make Dubuque less hospitable to persons with really bad criminal backgrounds than some other place.  That might result in them choosing another place to live. ”

So where are people who do have a criminal past suppose to live?

Harris said, “It’s a free market system. Tenants are going to find a place to live by one means or another and landlords have the option of renting to anyone they want to. ”

When it comes down to it, who gets to live in an apartment is still up to the landlord.

Maro said, “Different property owners will establish their own criteria as to what’s acceptable and what is not. ”

Maro says requirements might be difficult for some landlords, but says it gives them the power and the right to know who is living in their properties.

Dubuque’s housing rules prohibit landlords from refusing someone an apartment based on several factors including race, religion, and sexual identity. Having a criminal background is NOT one of protected those factors.
